Introduction

Welcome to Still ("we", "our", or "us"). These Terms of Service ("Terms") govern your use of our website, mobile applications, and other services (collectively, the "Service"). By accessing or using the Service, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using our Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.

3. Service Description

Still connects service providers ("Service Providers") with individuals seeking services ("Clients"). providers can list their services, manage appointments, and communicate with Clients. Clients can browse, book services, and interact with providers through the platform.

4. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for all activities that occur under your account.

5. User Responsibilities

5.1 Providers

providers must provide accurate information about their qualifications, services, and availability. If provider status is “Active”, provider must respond to client requests within 10 minutes.
providers are responsible for maintaining their licenses, certifications, and insurance as required by law.
providers must comply with all applicable laws and regulations in their provision of services

5.2 Clients

Clients must provide accurate information when booking services.
Clients agree to respect the schedules and policies of providers.
Clients are responsible for ensuring that their interactions on the platform comply with applicable laws and regulations.

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

Violating any applicable laws or regulations.
Infringing or violating our intellectual property rights or the rights of others.
Posting any content that is harmful, abusive, offensive, or otherwise objectionable.
Using the Service for any fraudulent or deceptive purposes.

7. Payment Terms

Third-party payment processors process payments for services booked through the platform. By making a payment through our Service, you agree to the terms and conditions of the respective payment processor. We are not responsible for any issues arising from payment processing.

8. Cancellation and Refunds

For Same-Day Appointments:

If the client cancels:

Cancellations made within 30 minutes of booking are eligible for a full refund.
Cancellations made 3 or more hours before the appointment receive a 50% refund.
Cancellations made less than 3 hours before the appointment are non-refundable.

If the provider cancels:

The client receives a full refund, and the provider receives no payment.

For Next-Day or Later Appointments:

If the client cancels:

Cancellations made 24 hours or more before the appointment receive a full refund.
Cancellations made within 24 hours of the appointment are eligible for a 50% refund.
Cancellations made within 1 hour of the appointment are non-refundable.

If the provider cancels:

• The client receives a full refund, and the provider receives no payment.

9. Intellectual Property

All content and materials on the Service, including text, graphics, logos, and software, are the property of Still or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the Service without our express written permission.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy or completeness of the content available on or through the Service. We disclaim all warranties, whether express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

12. Indemnification

You agree to indemnify and hold harmless Still, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms and any action related thereto will be governed by the Federal Arbitration Act, federal arbitration law, and the laws of the State of California, without regard to its conflict of laws provisions.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
